Terms of Use

This agreement (the "Terms") is made, depending on whether you are signing up for the Service (as defined below) as an individual or on behalf of an entity that you represent, between (1) the individual or company stated on the registration form for the Service (the "Registration Form") and (2) Webpushr. Reference to "you" or "your" are to the individual or company described on the Registration Form. If you are signing up on behalf of a corporate entity, you warrant and represent that you have legal authority to enter into these Terms on behalf of the entity that you represent and in doing so will bind the entity you represent.

Your use of the service described and made available at www.webpushr.com as updated from time to time (the "Service") is governed by these Terms.

Your Account

You must provide accurate and complete registration information any time you register to use the Service. You are responsible for the security of your passwords and for any use of your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify Webpushr immediately.

You must only create one account for all of your sites. Creating multiple accounts is a violation and can result in the termination of our service to you.

Change and Termination of the Service

Webpushr is constantly innovating in order to provide the best possible experience & functionality for its users. You acknowledge and agree that the form and nature of the Service which Webpushr provides may change from time to time without prior notice to you. Changes to the form and nature of the Service will be effective with respect to all versions of the Service (including previous versions of the Service); examples of changes to the form and nature of the Service include without limitation changes to fee and payment policies, security patches, added functionality, and other enhancements.

You may discontinue your use of the Service at any time. Webpushr may, at any time, terminate your use of the Service for any reason what so ever.

If you are a paying customer, you reserve the right to cancel your subscription at any time. Webpushr requires an e-mail notification from you, the customer, to stop automatic collection of appropriate fees.

Exclusion of Warranties

You expressly understand and agree that your use of the service is at your sole risk and that the service is provided "as is" and "as available.".

Webpushr makes no express warranties and, to the extent you use the service in the course of a business, disclaim all implied warranties regarding the service including implied warranties of satisfactory quality, merchantability, fitness for a particular purpose and non-infringement. Without limiting the generality of the foregoing, Webpushr and affiliates do not represent or warrant to you that: (a) your use of the service will meet your requirements, (b) your use of the service will be uninterrupted, timely, secure or free from error, and (c) usage data provided through the service will be accurate.

Payment Terms

You agree to pay appropriate fees based on your number of push subscribers managed by Webpushr. If you elect to pay via credit card (like most users do), then you are responsible for either (a) adding more than one valid credit card to your profile, or (b) ensuring that your account(s) has a sufficient positive balance to cover all fees due. If, for any reason, you have a negative balance on your account, then we reserve the right to suspend the Services temporarily or permanently. All payments are payable in advance, at the beginning of your billing cycle. We reserve the right to suspend or permanently delete your account and all associated data including subscriber data if your account is found to be in repeated violation of our payment terms.

If we permanently delete your account and all associated data, pursuant to this Section, then we will have no liability for any damage, liabilities, losses (including any loss of data or profits) or any other consequences that you may incur in connection with any such action.

Webpushr reserves the right to charge you appropriate fees associated with maintaining your account. This includes upgrading your account to the appropriate pricing tier based on the number of push subcribers in your account.

You reserve the right to cancel your subscription at any time. Webpushr requires an e-mail notification from you, the customer, to stop automatic collection of appropriate fees.

Limitation of Liability

You expressly understand and agree that Webpushr, its subsidiaries and affiliates, and its licensors shall not be liable to you under or in connection with this agreement and whether in contract, tort (including negligence), for breach of statutory duty or otherwise, for any indirect, incidental, special consequential or exemplary damages, loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss, which may be incurred by you, however caused and under any theory of liability.

Export of Subscriber Data

You can make a special request (currently limited to a maximum of 1 per month, per account for non-enterprise customers) for us to export all Subscriber Data that we collect and store on our servers on your behalf as outlined here. "Subscriber Data" comprises of the data fields clearly outlined in the aforementioned page. As a security measure, we do not share site-specific encryption keys that our servers generate on your behalf for your specific site to enable web push.

We can also permanently delete your subscriber data if such an action is requested.

Keep in mind that while the aforementioned export of Subscriber Data can be useful to perform deeper analytics on your subscribers, this data-set cannot be used to move to a different push vendor. Because of how Push Notification technology is designed, you cannot copy/paste (import/export) your subscriber data from one vendor to another. Over 40% of our customers were previously using a different push vendor and decided to migrate to Webpushr. These customers who transferred to Webpushr were therefore given no option or capability to "import" their Subscriber Data from their previous push vendor. Learn more on how they transferred to Webpushr here. Similarly, the aforementioned Subscriber Data that we manually export on your behalf cannot be used to transfer to a vendor other than Webpushr.

As a global platform for Web Push Notifications, Webpushr is deeply committed to supporting and protecting freedom of speech. At the same time, we draw lines around a few narrowly defined but deeply important categories, listed below, of content and behavior related websites that Webpushr does not support:

Webpushr reserves the right to update this list, at any time, without any prior notice. Webpushr also reserves the right to suspend any account found in violation of this policy, at any time, without any prior notice.

Harvesting of Push Subscriber Data. Websites that enable push notifications to simply collect push subscribers intending to later send them third party ads for monetization. Webpushr does not support the usage of Web Push technology to send third party ads. We strongly oppose the usage of Web Push for monetization purposes because, to us, it represents an egregious violation of your push subscribers' trust.

Terrorism: Webpushr should not be used on platforms that support and/or encourage acts of terrorism. That includes content which supports or celebrates terrorist organizations, their leaders, or associated violent activities.

Hate Speech: Websites that encourage violence or hatred. Websites that support content intended for promoting or inciting the hatred of, or dehumanizing, individuals or groups based on race, ethnic or national origin, religion, gender, gender identity, age, veteran status, sexual orientation, disability or disease. If you encounter a website that violates our hate speech policies, please report it.

Harm to Minors: Websites that post or solicit content that features the abuse of a minor, that includes suggestive or sexual content involving a minor or anyone that appears to be a minor, or that facilitates or promotes child sexual abuse.

Promotion or Glorification of Self-Harm: Websites that actively promote or glorify self-harm.

Adult Content: Websites that post or promote all types of adult content that includes pornography, nudity, etc.

Spam & Mass Registrations. Any type of user fraud.

Promoting 3rd party products, services or content. Websites that use push notifications to send Ads promoting various 3rd party products, services or content.
